Dovolujeme si V\u00e1m p\u0159edstavit n\u011bkolik novinek z oblasti judikatury a legislativy, kter\u00e9 ve\u0161ly v \u00fa\u010dinnost nebo byly projedn\u00e1v\u00e1ny v n\u011bkolika posledn\u00edch m\u011bs\u00edc\u00edch. O dal\u0161\u00edch zm\u011bn\u00e1ch V\u00e1s budeme informovat i v m\u011bs\u00edc\u00edch p\u0159\u00ed\u0161t\u00edch.<\/p>\n\n\n\n

Velk\u00e9 zm\u011bny v oblasti bytov\u00e9ho pr\u00e1va<\/strong><\/p>\n\n\n\n

Dne 1. 7. 2020 vstoupily v \u00fa\u010dinnost novely ob\u010dansk\u00e9ho z\u00e1kon\u00edku a z\u00e1kona o obchodn\u00edch korporac\u00edch, kter\u00e9 se v\u00fdznamn\u011b dot\u00fdkaj\u00ed bytov\u00e9ho spoluvlastnictv\u00ed a dru\u017estevn\u00edho bydlen\u00ed. V n\u00e1sleduj\u00edc\u00edch \u0159\u00e1dc\u00edch si V\u00e1s dovol\u00edme sezn\u00e1mit s t\u011bmi nejz\u00e1sadn\u011bj\u0161\u00edmi zm\u011bnami.<\/p>\n\n\n\n

BYTOV\u00c9 SPOLUVLASTNICTV\u00cd<\/u><\/strong><\/p>\n\n\n\n

Nejv\u00edce prob\u00edranou zm\u011bnou je zm\u011bna p\u0159edkupn\u00edho pr\u00e1va spoluvlastn\u00edk\u016f k nebytov\u00fdm prostor\u016fm p\u0159i p\u0159evodu jednotky. Toto p\u0159edkupn\u00ed pr\u00e1vo p\u0159evody jednotek zna\u010dn\u011b komplikovalo. Nyn\u00ed se tak\u0159ka ru\u0161\u00ed \u2013 z\u016fstalo zachov\u00e1no pouze v p\u0159\u00edpadech, kdy bytov\u00e9 spoluvlastnictv\u00ed vzniklo pro p\u0159\u00edpad smrti nebo z jin\u00e9ho d\u016fvodu, pro kter\u00fd vlastn\u00edci jednotek nemohli ovlivnit sv\u00e1 pr\u00e1va a povinnosti. Toto p\u0159edkupn\u00ed pr\u00e1vo v\u0161ak bude trvat jen po dobu prvn\u00edch 6 m\u011bs\u00edc\u016f existence takto vznikl\u00e9ho bytov\u00e9ho spoluvlastnictv\u00ed a nav\u00edc se neuplat\u00ed, kdy\u017e vlastn\u00edk jednotky, jej\u00ed\u017e sou\u010d\u00e1st\u00ed je i nebytov\u00fd prostor (kup\u0159. parkovac\u00ed m\u00edsto \u010di sklepn\u00ed k\u00f3je), jednotku p\u0159ev\u00e1d\u00ed sv\u00e9mu p\u0159\u00edbuzn\u00e9mu.<\/p>\n\n\n\n

Novela d\u00e1le p\u0159in\u00e1\u0161\u00ed zm\u011bny v pr\u00e1vech a povinnostech vlastn\u00edk\u016f jednotek. K pr\u00e1vu nahl\u00ed\u017eet do \u00fa\u010detnictv\u00ed a smluv se p\u0159ipojuje pr\u00e1vo po\u0159izovat si z t\u011bchto dokument\u016f v\u00fdpisy a kopie. Zejm\u00e9na se v\u0161ak zav\u00e1d\u00ed povinnost vlastn\u00edka hl\u00e1sit spr\u00e1vci vedle informace o nabyt\u00ed jednotky a sv\u00fdch osobn\u00edch \u00fadaj\u00edch tak\u00e9 \u00fadaj o tom, kdo bude jednotku, a jak\u00fdm pr\u00e1vem, u\u017e\u00edvat \u2013 tato povinnost je sou\u010d\u00e1st\u00ed \u0161ir\u0161\u00ed regulace kr\u00e1tkodob\u00fdch n\u00e1jm\u016f typu Airbnb. Vlastn\u00edk tak\u00e9 mus\u00ed hl\u00e1sit zm\u011bny t\u011bchto \u00fadaj\u016f a nov\u011b mu vznik\u00e1 tak\u00e9 povinnost hl\u00e1sit spr\u00e1vci stavebn\u00ed \u00fapravy sv\u00e9ho bytu.<\/p>\n\n\n\n

M\u011bn\u00ed se tak\u00e9 zp\u016fsob, jak se vlastn\u00edci mohou zbavit \u201enep\u0159izp\u016fsobiv\u00fdch\u201c vlastn\u00edk\u016f. Pokud n\u011bkter\u00fd z vlastn\u00edk\u016f poru\u0161uje soudem ulo\u017eenou povinnost zp\u016fsobem podstatn\u011b omezuj\u00edc\u00edm nebo p\u0159\u00edmo znemo\u017e\u0148uj\u00edc\u00edm v\u00fdkon pr\u00e1v ostatn\u00edch vlastn\u00edk\u016fm, a nezanech\u00e1 toho ani navzdory v\u00fdzv\u011b k zanech\u00e1n\u00ed, m\u016f\u017ee soud na n\u00e1vrh spr\u00e1vce na\u0159\u00eddit prodej jeho jednotky. N\u00e1vrh spr\u00e1vce v\u0161ak podl\u00e9h\u00e1 souhlasu nadpolovi\u010dn\u00ed v\u011bt\u0161iny v\u0161ech vlastn\u00edk\u016f.<\/p>\n\n\n\n

Zm\u011bny se dotkly tak\u00e9 spr\u00e1vy d\u011blen\u00fdch nemovitost\u00ed a spole\u010denstv\u00ed vlastn\u00edk\u016f (SVJ). Nov\u011b mus\u00ed SVJ povinn\u011b vzniknout v domech, ve kter\u00fdch jsou vymezeny alespo\u0148 4 jednotky ve vlastnictv\u00ed alespo\u0148 4 r\u016fzn\u00fdch vlastn\u00edk\u016f. Samotn\u00e9 SVJ se st\u00e1le zakl\u00e1d\u00e1 schv\u00e1len\u00edm stanov, ale nov\u011b, pokud SV zakl\u00e1d\u00e1 jedin\u00fd vlastn\u00edk, nemus\u00ed m\u00edt stanovy formu not\u00e1\u0159sk\u00e9ho z\u00e1pisu. A nehled\u011b na to, zda stanovy maj\u00ed nebo nemaj\u00ed formu not\u00e1\u0159sk\u00e9ho z\u00e1pisu, je lze nov\u011b m\u011bnit jakoukoli formou (tedy i bez not\u00e1\u0159sk\u00e9ho z\u00e1pisu) za p\u0159edpokladu, \u017ee se zm\u011bnou vyslov\u00ed souhlas v\u011bt\u0161ina vlastn\u00edk\u016f, leda\u017ee stanovy vy\u017eaduj\u00ed vy\u0161\u0161\u00ed po\u010det \u2013 souhlas v\u0161ak sta\u010d\u00ed d\u00e1t i mimo shrom\u00e1\u017ed\u011bn\u00ed.<\/p>\n\n\n\n

Novela se tak\u00e9 dotkla \u00fapravy n\u00e1jmu domu a bytu. Zat\u00edmco doposud byla ochrana n\u00e1jemc\u016f natolik siln\u00e1, \u017ee bylo zak\u00e1z\u00e1no sjednat v n\u00e1jemn\u00ed smlouv\u011b s nimi smluvn\u00ed pokutu, nov\u011b ob\u010dansk\u00fd z\u00e1kon\u00edk tuto mo\u017enost v\u00fdslovn\u011b dovoluje.<\/p>\n\n\n\n

BYTOV\u00c1 DRU\u017dSTVA<\/u><\/strong><\/p>\n\n\n\n

Novela z\u00e1kona o obchodn\u00edch korporac\u00edch usnad\u0148uje zp\u016fsob rozhodov\u00e1n\u00ed o zm\u011bn\u011b stanov bytov\u00e9ho dru\u017estva (BD). Zat\u00edmco doposud byla zm\u011bna mo\u017en\u00e1 jen se souhlasem v\u0161ech \u010dlen\u016f BD, nyn\u00ed se toto kvorum m\u011bn\u00ed tak, \u017ee ke zm\u011bn\u011b posta\u010d\u00ed souhlas t\u0159\u00ed \u010dtvrtin v\u0161ech \u010dlen\u016f BD \u2013 souhlas s n\u00ed v\u0161ak mus\u00ed vyslovit v\u0161ichni ti \u010dlenov\u00e9 BD, kter\u00fdm se t\u00edm maj\u00ed zm\u011bnit podm\u00ednky pro uzav\u0159en\u00ed smlouvy o n\u00e1jmu dru\u017estevn\u00edho bytu.<\/p>\n\n\n\n

Novela tak\u00e9 up\u0159es\u0148uje, \u017ee vedle standardn\u00edch d\u016fvod\u016f pro vylou\u010den\u00ed \u010dlen\u016f BD (uveden\u00fdch v \u00a7 734) se mohou aplikovat i obecn\u00e9 d\u016fvody pro vylou\u010den\u00ed \u010dlena dru\u017estva obecn\u011b (uveden\u00e9 v \u00a7 614). T\u00edm doch\u00e1z\u00ed k ujasn\u011bn\u00ed doposud nejasn\u00e9 pr\u00e1vn\u00ed ot\u00e1zky. Stejn\u011b tak z\u00e1kon nov\u011b up\u0159es\u0148uje problematiku b\u011b\u017en\u00e9 \u00fadr\u017eby a drobn\u00fdch oprav dru\u017estevn\u00edho bytu. Doposud se tyto pojmy vykl\u00e1daly za pou\u017eit\u00ed ji\u017e neplatn\u00e9 vyhl\u00e1\u0161ky ministerstva financ\u00ed, nov\u011b z\u00e1kon stanov\u00ed, \u017ee co se rozum\u00ed pod pojmy b\u011b\u017en\u00e1 \u00fadr\u017eba a drobn\u00e9 opravy, ur\u010d\u00ed stanovy.<\/p>\n\n\n\n

Omezen\u00e9 mo\u017enosti hospoda\u0159en\u00ed BD z\u016fst\u00e1vaj\u00ed, ale nov\u011b se zav\u00e1d\u00ed mo\u017enost rozd\u011blit \u010d\u00e1st zisku BD mezi jeho \u010dleny. Toto pr\u00e1vo v\u0161ak \u010dlen\u016fm mus\u00ed garantovat stanovy a nav\u00edc mezi n\u011b p\u016fjde rozd\u011blit jen 33 % z celkov\u00e9ho zisku BD, a to jen za p\u0159edpokladu, \u017ee \u010d\u00e1st z celkov\u00e9ho zisku BD ukl\u00e1d\u00e1 do nerozd\u011bliteln\u00e9ho fondu ve v\u00fd\u0161i nejm\u00e9n\u011b 30 % sv\u00e9ho z\u00e1kladn\u00edho kapit\u00e1lu.<\/p>\n\n\n\n

Novela z\u00e1kon\u00edku pr\u00e1ce<\/strong><\/p>\n\n\n\n

Velk\u00e9 zm\u011bny s sebou p\u0159in\u00e1\u0161\u00ed tak\u00e9 novely z\u00e1kon\u00edku pr\u00e1ce. Prvn\u00ed, kter\u00e1 se dot\u00fdk\u00e1 zejm. problematiky doru\u010dov\u00e1n\u00ed, vstoup\u00ed v \u00fa\u010dinnost 30. 7. 2020. Druh\u00e1, p\u0159in\u00e1\u0161ej\u00edc\u00ed zm\u011bny zejm. v oblasti dovolen\u00e9 a sd\u00edlen\u00fdch pracovn\u00edch m\u00edst, vstoup\u00ed v \u00fa\u010dinnost 1. 1. 2021.<\/p>\n\n\n\n

V oblasti doru\u010dov\u00e1n\u00ed novela zav\u00e1d\u00ed jako prim\u00e1rn\u00ed zp\u016fsob doru\u010dov\u00e1n\u00ed p\u00edsemnosti zam\u011bstnanci osobn\u011b na pracovi\u0161ti. Pokud se mu ji nepoda\u0159\u00ed doru\u010dit, nebude ji\u017e existovat \u017e\u00e1dn\u00e9 po\u0159ad\u00ed zp\u016fsob\u016f a zam\u011bstnavatel tedy bude moci vyu\u017e\u00edt jak\u00e9hokoli zp\u016fsobu doru\u010dov\u00e1n\u00ed. Pokud zvol\u00ed doru\u010dov\u00e1n\u00ed po\u0161tou, doru\u010duje se na adresu, kterou zam\u011bstnanec pro tyto \u00fa\u010dely zam\u011bstnavateli sd\u011bl\u00ed. Pro p\u0159\u00edpady doru\u010dov\u00e1n\u00ed p\u00edsemnost\u00ed zam\u011bstnancem zam\u011bstnavateli se nov\u011b zav\u00e1d\u00ed fikce p\u0159ijet\u00ed, pokud zam\u011bstnavatel odm\u00edtne doru\u010dovanou p\u00edsemnost p\u0159evz\u00edt nebo k tomu neposkytne pat\u0159i\u010dnou sou\u010dinnost.<\/p>\n\n\n\n

Novela se tak\u00e9 t\u00fdk\u00e1 p\u0159echodu pr\u00e1v a povinnost\u00ed. Nov\u011b se zav\u00e1d\u00ed pr\u00e1vo zam\u011bstnance d\u00e1t zam\u011bstnavateli v souvislosti s p\u0159echodem v\u00fdpov\u011b\u010f tak, aby ke skon\u010den\u00ed pracovn\u00edho pom\u011bru do\u0161lo je\u0161t\u011b p\u0159ed p\u0159echodem. Zabr\u00e1n\u00ed se tak p\u0159echodu zam\u011bstnanc\u016f ve v\u00fdpov\u011bdn\u00ed dob\u011b pod nov\u00e9ho zam\u011bstnavatele.<\/p>\n\n\n\n

Co se t\u00fd\u010de zm\u011bn ve v\u00fdpo\u010dtu dovolen\u00e9, tak zde novela ru\u0161\u00ed institut dovolen\u00e9 za odpracovan\u00e9 dny \u2013 z\u016fst\u00e1v\u00e1 tak jen dovolen\u00e1 za kalend\u00e1\u0159n\u00ed rok, jeho pom\u011brnou \u010d\u00e1st a dodatkov\u00e1 dovolen\u00e1. Nov\u011b se dovolen\u00e1 bude po\u010d\u00edtat nikoli za odpracovan\u00e9 dny, ale za odpracovanou t\u00fddenn\u00ed pracovn\u00ed dobu (v hodin\u00e1ch). Kr\u00e1tit dovolenou pak nov\u011b p\u016fjde pouze o neomluven\u011b zame\u0161kan\u00e9 sm\u011bny, a to o po\u010det zame\u0161kan\u00fdch hodin, nikoli dn\u016f, jako tomu bylo doposud.<\/p>\n\n\n\n

Velkou novinkou je tak\u00e9 zaveden\u00ed sd\u00edlen\u00e9ho pracovn\u00edho m\u00edsta (\u00a7 317a). Jeho podstatou je, \u017ee minim\u00e1ln\u011b 2 zam\u011bstnanci se stejnou pracovn\u00ed n\u00e1pln\u00ed a sjednanou krat\u0161\u00ed pracovn\u00ed dobou si po dohod\u011b se zam\u011bstnavatelem budou moci sami rozvrhovat pracovn\u00ed dobu (ve vz\u00e1jemn\u00e9 spolupr\u00e1ci) podle sv\u00fdch vlastn\u00edch pot\u0159eb tak, aby v\u00a0souhrnu ka\u017ed\u00fd naplnil ujednanou pr\u016fm\u011brnou pracovn\u00ed dobu nejd\u00e9le v 4t\u00fddenn\u00edm vyrovn\u00e1vac\u00edm obdob\u00ed, a to v\u00a0limitu max. 40 odpracovan\u00fdch hodin t\u00fddn\u011b.<\/p>\n\n\n\n

Zp\u011btn\u00e9 uplatn\u011bn\u00ed da\u0148ov\u00e9 ztr\u00e1ty<\/strong><\/p>\n\n\n\n

Poslaneck\u00e1 sn\u011bmovna schv\u00e1lila vl\u00e1dn\u00ed da\u0148ov\u00fd bal\u00ed\u010dek, jeho\u017e sou\u010d\u00e1st\u00ed je i novela z\u00e1kona \u010d. 586\/1992 Sb., o dan\u00edch z p\u0159\u00edjm\u016f, kter\u00e1 v reakci na koronavirovou krizi zav\u00e1d\u00ed mo\u017enost zp\u011btn\u00e9ho uplatn\u011bn\u00ed da\u0148ov\u00e9 ztr\u00e1ty. Zat\u00edmco dosud mohla b\u00fdt da\u0148ov\u00e1 ztr\u00e1ta uplat\u0148ov\u00e1na jako ode\u010ditateln\u00e1 polo\u017eka v p\u011bti bezprost\u0159edn\u011b n\u00e1sleduj\u00edc\u00edch zda\u0148ovac\u00edch obdob\u00edch, nov\u011b se tato mo\u017enost roz\u0161i\u0159uje tak\u00e9 na dv\u011b da\u0148ov\u00e1 obdob\u00ed bezprost\u0159edn\u011b p\u0159edch\u00e1zej\u00edc\u00ed (tedy za roky 2018 a 2019). Mo\u017enost zp\u011btn\u00e9ho uplatn\u011bn\u00ed ztr\u00e1ty je v\u0161ak limitov\u00e1na celkovou \u010d\u00e1stkou 30 milion\u016f K\u010d, nehled\u011b na da\u0148ov\u00e9 obdob\u00ed, a po\u010d\u00edt\u00e1 pro ztr\u00e1ty vznikl\u00e9 do 30. 6. 2020. Zp\u011btn\u00e9 uplatn\u011bn\u00ed da\u0148ov\u00e9 ztr\u00e1ty bude mo\u017en\u00e9 prost\u0159ednictv\u00edm dodate\u010dn\u00e9ho da\u0148ov\u00e9ho p\u0159izn\u00e1n\u00ed. Vznikne-li v d\u016fsledku toho da\u0148ov\u00e9mu poplatn\u00edku p\u0159eplatek, bude si muset po\u017e\u00e1dat o jeho vr\u00e1cen\u00ed. Zp\u011btn\u011b uplatnit da\u0148ovou ztr\u00e1tu v\u0161ak nebude mo\u017en\u00e9 po\u0159\u00e1d. Z\u00e1kon tu stanov\u00ed propadnou lh\u016ftu, podle kter\u00e9 lze da\u0148ovou ztr\u00e1tu zp\u011btn\u011b uplatnit nejpozd\u011bji za posledn\u00ed zda\u0148ovac\u00ed obdob\u00ed, za kter\u00e9 bylo mo\u017en\u00e9 ztr\u00e1tu naposledy uplatnit. Pr\u00e1va na uplatn\u011bn\u00ed da\u0148ov\u00e9 ztr\u00e1ty se nicm\u00e9n\u011b poplatn\u00edci mohou vzd\u00e1t, a pak jim lh\u016fta za p\u0159edch\u00e1zej\u00edc\u00ed da\u0148ov\u00e1 obdob\u00ed pob\u011b\u017e\u00ed norm\u00e1ln\u011b.<\/p>\n\n\n\n

Realitn\u00ed zprost\u0159edkov\u00e1n\u00ed<\/strong><\/p>\n\n\n\n

V reakci na koronavirovou krizi byla p\u0159ijata novela z\u00e1kona o realitn\u00edm zprost\u0159edkov\u00e1n\u00ed (z\u00e1kon \u010d. 190\/2020 Sb.), kter\u00fd prodlu\u017euje lh\u016ftu pro p\u0159echod t\u00e9to \u017eivnosti z voln\u00e9 na v\u00e1zanou o \u010dty\u0159i m\u011bs\u00edce, tedy do 31. 3. 2021. Na tomto m\u00edst\u011b se slu\u0161\u00ed p\u0159ipomenout, \u017ee v d\u016fsledku t\u00e9to zm\u011bny budou muset realitn\u00ed zprost\u0159edkovatel\u00e9 nov\u011b spl\u0148ovat ur\u010dit\u00e9 podm\u00ednky co do jejich odborn\u00e9 zp\u016fsobilosti (podm\u00ednkou pro dal\u0161\u00ed v\u00fdkon t\u00e9to \u017eivnosti bude vysoko\u0161kolsk\u00e9 magistersk\u00e9 vzd\u011bl\u00e1n\u00ed v oboru ekonomie, stavebnictv\u00ed nebo podobn\u00e9ho oboru, p\u0159\u00edp. vysoko\u0161kolsk\u00e9 bakal\u00e1\u0159sk\u00e9 vzd\u011bl\u00e1n\u00ed za podm\u00ednky ro\u010dn\u00ed praxe v oboru a absolvov\u00e1n\u00ed mezin\u00e1rodn\u011b uzn\u00e1van\u00e9ho kurzu, nebo p\u0159\u00edp. vysoko\u0161kolsk\u00e9 \u010di st\u0159edo\u0161kolsk\u00e9 vzd\u011bl\u00e1n\u00ed s maturitn\u00ed zkou\u0161kou a alespo\u0148 t\u0159emi lety praxe \u2013 realitn\u00ed zprost\u0159edkovatel\u00e9, kte\u0159\u00ed sami tuto podm\u00ednku nespl\u0148uj\u00ed, si mohou naj\u00edt osobu odpov\u011bdn\u00e9ho z\u00e1stupce, kter\u00e1 tyto podm\u00ednky spl\u0148uje).<\/p>","protected":false},"excerpt":{"rendered":"
